Terry Hirby, of Cobb County, pleaded guilty to three charges against him. Those charges were possession of a firearm by a convicted felon, possession less than ounce of marijuana, and a seatbelt violation, according to court documents.
Courtroom testimony stated that Hirby was cleaning out his deceased father’s home and found a Remington 700 rifle, a deer stand, and other similar items.
Hirby told the judge he knew who owned the items and decided to return them in his vehicle.
He was traveling in the Stonebrook Drive area of Rockmart and trying to get a cell phone signal to call the weapon’s owners, according to his testimony Tuesday.
That’s when police officers stopped him.
Court documents state Hirby wasn’t allowed to have a gun because of a 1994 Cobb County conviction of a charge of possession of tools for the commission of a crime.
Hirby said he hasn’t been in legal trouble since that charge.
Sutton told Hirby he should have known better than to be in a possession of any weapon.
The judge sentenced Hirby to seven years probation, fined him a total of $2,035 for the three charges and told him that he is not to ever come to the Tallapoosa Circuit ever again, which includes Polk and Haralson Counties.
